for participation in the „BMW ALPINA B3 Saloon scale model“ competition
ALPINA collects personal data in order to run the competition. In particular, these are the form of salutation, title, last name as well as e-mail address. In the event of winning, the winner will also be asked to provide a shipping address to which the prize is to be sent (name, address supplement, street, postcode, city, country).
The data will be processed exclusively for the purpose of conducting the competition (Art. 6 para. 1 lit. b GDPR). This includes the following purposes:
– to draw a winner, notify him/her and send the prize;
– to notify all participants of the termination of the competition, even those who did not emerge from the drawing as winners;
– to comply with tax and commercial law obligations of documentation or storage;
– and to be able to adequately defend ourselves against any complaints or cease-and-desist letters in connection with the competition or the prizes.
The processing of your personal data is lawfully conducted on the basis of the EU GDPR, in particular to carry out the competition as well as to meet the legal obligations and to protect our legitimate interest in the defence against claims asserted against us in connection with the competitions and prizes (see GDPR Art. 6 para. 1 lit. b, c and f).
We use the rapidmail mailing program to send e-mails in connection with the competition. The data of the participants in the competition are thus transmitted to rapidmail GmbH in the role of a processor. rapidmail GmbH is not allowed to use your data for purposes other than notifying of the termination of the competition by e-mail. rapidmail GmbH is also not authorized to pass on or sell your data. rapidmail is a certified German software provider for newsletters and was carefully chosen according to the requirements of the GDPR and the German Federal Data Protection Act (BDSG).
As soon as the business purpose of conducting the competition has been fulfilled and you have not been identified as a winner, we will delete your data within three months of terminating the competition. If you were identified as a winner, there are tax and commercial law retention periods that need to be complied with. Pursuant to Art. 147 para. 1 of the German Tax Code (AO), these are 10 years for accounting records and pursuant to Art. 257 para. 1 of the German Commercial Code (HGB) 6 years for business documents.
