Terms and conditions of participation
for participation in the „BMW ALPINA B3 Saloon scale model“ competition
Organiser
The organiser of the competition is ALPINA Burkard Bovensiepen GmbH + Co KG, Alpenstraße 35-37, 86807 Buchloe, Germany (hereinafter „ALPINA“). Further information on ALPINA can be found at https://alpina.de/legal/.
Participants and requirements for participation
Only natural persons of full age and unrestricted legal capacity who have declared their consent to these terms and conditions of participation are entitled to participate.
Participation is granted with completion of an online registration by truthfully providing the participant’s personal data. The following mandatory information, which is necessary to run the competition, must be provided for this purpose: Last name, salutation and e-mail address.
The deadline for entries to the competition is 10/09/2024, 12:00 p.m.
Participation itself is free of charge and independent of the purchase of any goods or services. Multiple participation is not permitted.
Exclusion from participation
Participants whose personal details are not true will be excluded from participation. Further, such participants will also be excluded who manipulate or attempt to manipulate the participation process and/or the competition and/or otherwise violate the terms and conditions of participation. Employees of the organiser, its subsidiaries and affiliates, employees of companies participating in the competition and their relatives are excluded from participation in the competition. The exclusion may also take place retrospectively and any prize may be reclaimed in this case.
Conduction of the competition, notification of winnings
The winners will be drawn at random no later than seven days after the deadline for entries. The winners will be notified by ALPINA by e-mail with further details („Winning Notification“), with any claim to a prize only arising if the winner declares acceptance of the prize to ALPINA within seven calendar days of sending the winning notification („Winning Acceptance“). If the winner does not declare a Winning Acceptance within this period, a new winner will be drawn. If the prize has been successfully handed over to the winner, the remaining participants in the competition will be notified by e-mail of the termination of the competition (»Notification of the non-winners«).
Prize
The winner will receive a “BMW ALPINA B5 GT Sedan (G30) Arctic Race Blue 1:87 Limited Edition scale model” (order number 76 01 100) worth 49 € (incl. 19 % German sales tax) and a “BMW ALPINA B5 GT Touring (G31) Daytona Violet 1:87 Limited Edition scale model” (order number 76 01 101) worth 49 € (incl. 19 % German sales tax).
As a rule, the prize will be sent by post to the address indicated by the winner. The costs incurred for shipping will be borne by ALPINA. Import duties and taxes that may be incurred on shipment abroad once the shipment reaches the country of destination shall be borne by the winner, as shall any additional customs clearance charges. As customs regulations vary from country to country and ALPINA has no influence on the duties, no information can be provided about possible costs. Please contact your local customs office for detailed information on possible costs and duties.
Upon surrender of the prize to a carrier, the risk is transferred to the winner. We shall accept no liability for damage during transport.
If delivery of the prize by post is unsuccessful, ALPINA reserves the right to draw a new winner. If the contact details provided are incorrect or incomplete (e.g. postal or e-mail addresses), ALPINA shall not be obliged to determine the correct addresses. The detriments resulting from indicating incorrect or incomplete contact details (e.g. incorrect postal or e-mail address) shall be at the expense of the participant.
Depending on availability, ALPINA reserves the right to provide a service of at least equal value as a prize instead of the one specified above.
Insofar as the above information refers to the date or time period of the services won as a prize, the winning refers only to such date or period.
A cash disbursement of winnings is not possible. Claims to prizes are not transferable to other persons and cannot be exchanged.
Early termination and modification of the competition
ALPINA reserves the right to terminate or modify the competition at any time without notice if, for technical or other reasons, the proper execution of the competition cannot be guaranteed or if the fairness of the competition appears to be impaired. This does not give rise to any claims for participants.
Liability of ALPINA
ALPINA is only liable for intentional and grossly negligent conduct. This does not apply in the event of a negligent breach of a principal contractual obligation. These are obligations which are essential for conducting the competition, as they make the latter possible in the first place, and on the fulfilment of which the participant therefore relies and is entitled to rely. In this case, ALPINA’s liability in case of ordinary negligence is limited to the damage which is typical of the competition and foreseeable.
For damages resulting from injury to life, body or health, this limitation of liability does not apply.
Miscellaneous
Any taxes for benefits in kind will be paid by ALPINA (Art. 37b German Income Tax Act (EstG)).
Any legal recourse is excluded. There is no enforceable claim to a prize or payment of the cash value. These terms and conditions of participation and the entire legal relationship between the participant and ALPINA are subject exclusively to German law.
